Welcome to GameNexus. These Terms of Service ("Terms") govern your access to and use of the GameNexus mobile application, website, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account, downloading our app, or using any part of the Service, you agree to these Terms and our Privacy Policy. If you do not agree, you may not use the Service.

2. Eligibility

You must be at least 13 years old to use GameNexus. If you are under 18, you must have permission from a parent or legal guardian. By using the Service, you represent that you meet these requirements.

3. Account Registration

• You must provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Content

4.1 Your Content

You retain ownership of content you create or upload to GameNexus, including reviews, ratings, comments, and collection data ("User Content"). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content in connection with the Service.

4.2 Content Standards

You agree not to post User Content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene.
• Infringes on intellectual property rights or privacy rights of others.
• Contains viruses, malware, or other harmful code.
• Impersonates any person or entity or misrepresents your affiliation.
• Contains spam, advertising, or promotional content without authorization.
• Violates any applicable laws or regulations.

4.3 Content Moderation

We reserve the right to review, monitor, and remove User Content that violates these Terms or is otherwise objectionable, without prior notice. We are not obligated to monitor User Content but may do so at our discretion.

5. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws.
• Attempt to gain unauthorized access to our systems or other users' accounts.
• Interfere with or disrupt the Service or servers.
• Use automated tools (bots, scrapers) to access the Service without permission.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Collect or harvest personal information of other users.
• Engage in any activity that could harm GameNexus or its users.

6. Intellectual Property

6.1 Our Rights

The Service, including its design, features, graphics, logos, and software, is owned by GameNexus and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

6.2 Third-Party Content

Game information, images, and metadata are sourced from third-party providers (IGDB, retailers) and remain the property of their respective owners. We do not claim ownership of this content.

6.3 Trademarks

GameNexus, our logo, and related marks are trademarks of GameNexus. You may not use these marks without our prior written consent.

7. Subscriptions and Payments

7.1 Premium Subscriptions

GameNexus offers premium subscription plans with additional features. Subscription fees are charged through the Apple App Store or Google Play Store and are subject to their payment terms.

7.2 Billing

• Subscriptions automatically renew unless canceled before the renewal date.
• You authorize us to charge your payment method for recurring subscription fees.
• Prices are subject to change with notice.
• Refunds are handled according to Apple App Store and Google Play Store policies.

7.3 Cancellation

You may cancel your subscription at any time through your device's app store settings. Cancellation takes effect at the end of the current billing period.

8. Third-Party Services

The Service may integrate with or link to third-party services (Google OAuth, payment processors, retailers). We are not responsible for the content, policies, or practices of these third parties. Your use of third-party services is subject to their terms and policies.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

• We do not guarantee the accuracy, completeness, or reliability of game data, prices, or availability.
• We do not warrant that the Service will be uninterrupted, secure, or error-free.
• We are not responsible for third-party content or services.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GAMENEXUS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless GameNexus and its affiliates from any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or related to:

• Your use of the Service.
• Your violation of these Terms.
• Your User Content.
• Your violation of any rights of another party.

12. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause or notice, including for violation of these Terms. Upon termination:

• Your right to use the Service immediately ceases.
• We may delete your account and User Content.
• Sections of these Terms that by their nature should survive termination will remain in effect.

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles.

13.2 Arbitration

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

15.5 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control.
